Maternity Leave: What, When, How?

While you have waited quite long for the birth of your little one, the postpartum period can be challenging. If you are a new mom, you would be trying to figure out a number of things because let’s face it: baby books and all those amounts of reading couldn’t guide you in practical terms. Moreover, your baby needs you now; they know you, recognize your touch and want you by their side.


In such a case, going back to the office and immediately starting your work life may neither do you nor your baby much good. This is where maternity leave is recommended and in fact, extremely beneficial for both of you.



What is Maternity Leave?

The Government of India introduced the Maternity Benefit Act in 1961, which allows a woman to seek paid leave from her employer in light of giving birth and taking care of her newborn baby. The Act recognizes that a woman goes through a myriad of changes during this time and therefore, is eligible to temporarily stop working for the company with full compensation.

In addition to this, the woman is eligible for ‘medical bonus’ to be paid by the employer as well as nursing breaks during the course of her work.


Amendments in 2017

The Maternity Amendment Act of 2017 brought significant changes to the existing act, in light of the changing work culture. 


  • It increased the duration of leave to 26 weeks from the existing 12, provided work from home option depending on the nature of the work, after the said 26 weeks and sought to enhance employee awareness.

  • The prenatal benefit can be availed 8 weeks before the due date while post-delivery, it is 18 weeks.

  • There must be a creche facility in the organization with more than 50 employees.

  • A highlight of the bill is the fact that it allows similar benefits with a few changes for adoptive mothers who are adopting children below three months of age and commissioning mothers.

  • A miscarriage brings down the duration of the leave to 6 weeks from the date of the incident. 



Eligibility of Maternity Leave

A woman who has worked in the company for at least 80 days in the past 12 months shall be eligible for leaver under the Maternity Benefits Act. To avail this, the to-be mother needs to give her employer notice in writing, stating her request for maternity benefit to which she is entitled. It is important to mention that she would not work in any other organization during this course of time. The employer must be made aware of the need for such leave at least 2 months in advance.

Moreover, not just the to-be mother, but a woman can also nominate a to-be mother for maternity leave.


Maternity Leave Duration:

  • First-time mothers and a mothers having a second child:

If you are a first-time mother or one who is having a second child, you would be eligible for a leave of 26 weeks.


  • Mothers having a third child:

If you are having a third child, you would be eligible for a period of 12 weeks of leave which would be 6 weeks for prenatal leave and the remaining 6 for after the delivery.


  • Miscarriage or Abortion:

A miscarriage or abortion allows a leave benefit for up to 6 weeks. On the other hand, a tubectomy operation allows a 2-weeks leave benefit.


Leave for a Government Employee:

A government employee is given a few more benefits in addition to this. According to the Central Civil Service Rules, a woman is eligible for a 6 months maternity leave. Additionally, she can opt for childcare leave up to 2 years until the child turns 18 years old.


Is the Leave Taxable?

Yes, it is. Your maternity leave would be no different from your paycheck and the compensation until 26th week would be paid in full by the employer. However, if you wish to extend the leave beyond the 26th week, the same shall be unpaid. 


Can Your Employment be Terminated for Your Pregnancy?

Absolutely not! Under no circumstances can the employer fire you based on any such reason. It is illegal and you can take the help of law in case of any such mishaps.


Planning for a baby is a wonderful and one of the most important decisions of your life. If both you and your partner are working, you both must create an organised plan for taking care of your little one. Not just physical health, but your mental well-being must be ensured as well. The Maternity Benefit Act safeguards that you are not at a disadvantage in your career due to your bodily needs or the needs of your baby. Moreover, the benefit can be quite helpful to manage your growing additional expenses.

The government now has specific rules and regulations in place to support expecting mothers. It is illegal now to engage a pregnant woman in activities that may affect the development of her child in the six weeks before her expected delivery.


Maternity Leave 

Paid maternity leave is the right of every working pregnant woman and in no situation can she be denied this. An employer is entitled to pay the woman her wages as equal to what she was receiving until now for six weeks after her delivery. This means that no matter which company you are working in and what your income may be, it is your right to demand for paid maternity leave to help you take care of your child while not compromising on your career. While most women are familiar with maternity leave, what they often forget is that this is a right and not an obligation. While a woman is barred from being employed for six weeks after her delivery, this is not the case before the delivery. A woman can avail some of her maternity leave before the baby is born but she cannot be forced to do this, as long as she is able to complete her assigned duties and work.


No Forced Resignations

When she announced her pregnancy to her employer, Sheetal (name changed for privacy) was asked to resign from her position. While she definitely wanted to keep her child, so did she want to keep the job. She was hoping to return to office after her delivery but the situation seemed grim now. What Sheetal did not know, however, was that this was something that she could take her employer to the court for. It has been prohibited to dismiss a woman based on her pregnancy or maternity leave internationally. Additionally, she needs to be given special protection to safeguard her and her child during this period. 



Being pregnant is, without doubt, a beautiful period for a woman - working or not.
